End User License Agreement
Effective August 31, 2026
This End User License Agreement ("Agreement") governs your access to and use of QuextFlight, including its iPad application, downloadable data, website, and related services (collectively, the "Software"). By installing, accessing, or using the Software, you agree to this Agreement.
1. Ownership and License
QuextFlight is a wholly owned brand of Quext Interactive Technologies, Inc. ("Quext Interactive," "we," "us," or "our"). Quext Interactive retains all right, title, and interest in and to the Software, including all associated intellectual-property rights.
Subject to your compliance with this Agreement and any applicable subscription requirements, Quext Interactive grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Software for your personal or authorized aviation planning, training, and operational-awareness purposes. The Software is licensed, not sold.
2. Informational and Advisory Use Only
The Software is provided for informational and advisory purposes only. It is not a substitute for current official aeronautical information, notices, charts, weather products, aircraft flight manuals, required inspections, pilot judgment, or compliance with applicable laws, regulations, operating limitations, and procedures.
The pilot in command is the final authority as to the safe operation of the aircraft. QuextFlight must never be used as a replacement for sound aeronautical judgment, as a means of navigation, for flying an approach, or as a means to violate or avoid compliance with any Federal Aviation Regulations.
You are solely responsible for verifying all information used for a flight, determining the airworthiness and suitability of the aircraft and equipment, obtaining and reviewing current official sources, and making all operational decisions. You must not rely on the Software as the sole source of information for any flight decision.
3. No Warranty; Information May Be Incomplete or Expired
THE SOFTWARE AND ALL INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." QUEXT INTERACTIVE MAKES NO GUARANTEE, REPRESENTATION, OR WARRANTY THAT THE SOFTWARE OR ANY DATA, CONTENT, CALCULATION, ALERT, CHART, WEATHER PRODUCT, NOTAM, PROCEDURE, AIRPORT DETAIL, TERRAIN OR OBSTACLE INFORMATION, OR OTHER INFORMATION IS COMPLETE, ACCURATE, CURRENT, AVAILABLE, ERROR-FREE, OR SUITABLE FOR A PARTICULAR PURPOSE.
Information in the Software may be missing, omitted, incorrect, delayed, unavailable, superseded, or expired. To the maximum extent permitted by law, Quext Interactive disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, and uninterrupted availability.
4. Third-Party Information, Services, and Permitted Use
QuextFlight accesses, displays, processes, or relays third-party information and services only to provide the Software's intended functions. Depending on the features you use, current integrated sources and providers include the following. Their products, information, names, marks, interfaces, and materials remain subject to their respective rights, notices, licenses, terms, and policies.
- Federal Aviation Administration (FAA), AeroNav, and FAA NMS: aeronautical data, NASR and CIFP records, charts, procedures, Chart Supplement information, obstacles, and NOTAM information. See the FAA web policies and applicable FAA data service terms.
- NOAA, the National Weather Service, NCEP, Aviation Weather Center, and nowCOAST: aviation weather observations, forecasts, warnings, imagery, and related weather products. See the NWS disclaimer and policies.
- Iowa Environmental Mesonet (IEM): radar and forecast imagery, including NEXRAD and model-derived products. See the IEM service site and published notices.
- NASA Aviation Safety Reporting System (ASRS): public safety-reporting material and related information. See the NASA ASRS program site and applicable NASA information policies.
- U.S. Geological Survey (USGS): terrain and elevation information. See the USGS copyrights and credits policy.
- Esri: selected map, feature, and geospatial services. See Esri legal terms and Esri data attributions.
- OpenStreetMap contributors: selected base-map tiles and geographic features. See the OpenStreetMap copyright and license notice.
- NOTAC: supplemental aviation notice and airport information, where available. See the NOTAC service site and notices.
- Leidos Flight Service: flight-plan filing and related services when you elect to use that connection. Your use is subject to the applicable Leidos Flight Service terms and service requirements.
- AirNav: supplemental fuel-price reference information, where available. See the AirNav policies and notices.
- Apple: Apple Maps/MapKit content, Sign in with Apple, and Apple push-notification services when enabled. See the Apple Maps terms and Apple privacy policy.
- Google: Google Sign-In and place-search services when enabled. See the Google Terms of Service and Google Privacy Policy.
- Cloudflare and Amazon Web Services: security, authentication, data delivery, and object-storage infrastructure used to deliver parts of the Software. See the Cloudflare terms and AWS service terms.
- OpenAI: optional assistance features, if enabled for your account or deployment. See the OpenAI Terms of Use.
- Twilio and Twilio SendGrid: optional support calling, messaging, and email-delivery services. See the Twilio terms and applicable service requirements.
- Laminar Research X-Plane: optional simulator telemetry when you connect QuextFlight to your separately licensed simulator. Your use remains subject to the applicable X-Plane policies and license terms.
Third-party information and services may be public, licensed, proprietary, confidential, copyrighted, trademarked, protected by database rights, or subject to contractual, privacy, security, attribution, access, or rate-limit restrictions. Government-originated information is not necessarily free of all restrictions: source-specific terms, notices, and markings control. You receive no ownership interest or independent license in third-party material beyond the limited right to view and use it through the normal, intended operation of the Software.
You may use third-party information made available through QuextFlight solely for your personal or otherwise authorized aviation planning, training, and operational-awareness purposes, and only through the Software's intended interfaces. You must not extract, scrape, harvest, copy, systematically cache, republish, redistribute, sell, sublicense, create derivative data products from, remove attribution from, reverse engineer access to, share credentials for, or circumvent any security, access-control, or rate-limit measure applicable to that information or service. You must comply with all applicable provider terms, notices, licenses, and laws. The list above may change as providers, products, or features change; we may update this Agreement to reflect those changes.
Third-party information is supplemental and must not be treated as an official source, a replacement for required preflight or in-flight information, or a basis to disregard current official publications, NOTAMs, weather products, regulations, aircraft limitations, or pilot judgment.
5. Limitation of Liability
To the maximum extent permitted by law, Quext Interactive and its officers, directors, employees, contractors, licensors, and service providers will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, aircraft use, or flight opportunity, arising from or related to the Software or any information made available through it.
6. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Quext Interactive Technologies, Inc., QuextFlight, and their officers, directors, employees, contractors, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of, reliance on, or inability to use the Software or any information made available through it, including information that is missing, omitted, incorrect, delayed, unavailable, superseded, or expired.
7. Changes to This Agreement
We may update this Agreement from time to time. The effective date above identifies the most recent version. Continued use of the Software after an updated Agreement becomes effective constitutes acceptance of the updated Agreement.
